The following provisions will apply to bidders participating in online bidding:
1. Winner’s credit card on file will charged the full amount for each successful bid. Winner will receive an immediate email acknowledgement at the conclusion of the bidding phase followed by a paid invoice once their payment has processed.
2. In the event the card is declined, DSC Texas Panhandle Chapter will make one attempt to contact the winner to obtain a new form of payment. If the bidder cannot be reached, DSC Texas Panhandle Chapter may, in its sole and absolute discretion, re-sell the affected item. Online bidders are encouraged to remain available via cell phone during the bidding process.
3. Online winners will be assessed a Buyer's Premium (5% or $250, whichever is less) on the total winning bid amount for each online purchase. The Buyer’s Premium will be included in the total charged for each item.
4. Online bidders agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted during the online auction.
5. DSC Texas Panhandle Chapter reserves the right, for any reason, in its sole discretion, to terminate, change or suspend any aspect of the online auction.
6. If bidder dissatisfaction occurs with the online auction in any way, bidder’s only recourse is to immediately discontinue use of the online auction before items have been purchased.
7. DSC Texas Panhandle Chapter reserves the right to terminate bidder registration and use of the online auction, and impose limits on certain features of the online auction or restrict bidder access to, or use of, part or the entire online auction without notice or penalty.
8. All items sold through DSC Texas Panhandle Chapter are received from third party vendors. GOODS: All goods in the live auctions, silent auctions and raffles have been acquired or obtained from third parties. The high bidder acknowledges that the goods have not been inspected by DSC Texas Panhandle Chapter, and is advised, in the case of firearms, knives, bullets or other weapons to secure a competent inspection and test of the goods before use. The goods in the live auctions are sold “as is” with all faults and defects, and without any express or implied warranty on the part of DSC Texas Panhandle Chapter. DSC Texas Panhandle Chapter makes no warranties of fitness or merchantability, and expressly disclaims the same. DSC Texas Panhandle Chapter does not accept any responsibility or liability for any product, design or use. 9. Bidder acknowledges that the online auction bidding phase is conducted electronically and relies on hardware and software that may malfunction without warning. DSC Texas Panhandle Chapter will not be responsible for error or failures to execute bids placed via the internet, including, without limitation, errors or failures caused by (i) a loss of connection on DSC Texas Panhandle Chapter`s or bidder`s end (ii) a breakdown or problems with the online bidding software and /or (iii) a breakdown or problems with a bidder`s internet connection, computer or system.
