The goods covered by this auction form are sold as is with all faults and defects and without any expressed or implied warranty on the part of Chapter including but not limited to warranties of fitness and merchantability. Chapter accepts no responsibility or liability for the goods design or use. Any written warranty with respect to the goods delivered to the purchaser are those solely of the manufacturer of the goods.
Services – All services covered by this auction form have been acquired or obtained from and are to be furnished by third parties. No services covered by this auction form are to be performed by the Chapter. Chapter shall bear no responsibility for the delivery or quality of any such services or any loss or damage arising from, or related to or connected with the performance or non-performance of such services. The purchaser further agrees that in the event the services purchased are outside the United States, Chapter cannot be responsible or liable for any political unrest or instability related to the rendition of such services nor shall Chapter be held accountable for any injuries or damages that may arise therefrom.
Purchaser agrees that his or her purchase hereunder is NON-REFUNDABLE under any and all circumstances and that should legal action be taken by or against Chapter in connection with the goods or services purchased pursuant to this auction form, then the purchaser shall be responsible for any and all of the Chapter’s reasonable attorney’s fees and other legal costs.
This auction form and the terms and conditions hereof apply to and are binding on the heirs, legal representatives, successors and assigns of purchaser and Chapter. This auction form and the Auction Rules contained in the Program for this Event contain the entire agreement between the parties and cannot be changed except by an instrument subsequently executed by the purchaser and Chapter.
