AUCTION RULES & PROCEDURES
By submitting an electronic bid in American Custom Gunmakers Guild (afterwards referred to as ACGG) auction in February 2026, the bidder acknowledges and agreed to the following:
LIVE AUCTION BIDDING PROCEDURES
To participate in the live auction, the bidder will take responsibility to read the description of each item carefully prior to the auction. The auctioneer will not read and review the full description of each item.
Due to limitations established by third party donors, there may be a minimum bid necessary in order to sell an item. Specific goods and/or services described in the official auction offering constitute the full and complete agreement between the high bidder and ACCG, its Board of Directors and donors, individually and/or collectively. The ACGG Board of Directors reserves the right to accept or reject any bid offered on an item identified in the auction item description as having a reserve bid.
If bidding on a trip or hunt, the bidder shall recognize that some of the items on donated trips may include additional expenses not listed in the description including, but not limited, to the following: travel expenses to and from destination; hotel and meals before and after the hunt; alcoholic beverages; trophy dipping, packaging and shipping; gratuities; and value added tax (VAT). Trips may not be transferred, re-sold or bartered by winning bidder(s) without prior written agreement from both donor and ACGG.
Most trips, unless otherwise noted, are for specific dates. Donated trips MUST be taken during the dates specified unless special arrangements have been agreed upon with the donor in writing in advance. Donors are under no obligation to honor trips outside date range(s) specified. The bidder should not bid on trips if there is any question you will be able to take the trip within the specified time frame. The buyer must contact the donor within 30 days of the auction to arrange scheduling. It is the buyer's responsibility to communicate, and to apply for any required tags by stated deadlines, NOT the responsibility of ACGG, nor the donor. Any arrangements other than as set forth in the auction listing are expressly between the donor and bidder.
All bids submitted are legally binding offers to purchase and, if accepted as the high bid by the auctioneer, constitutes a legally binding contract between the bidder and ACGG. Once submitted, no bid may be removed. Successful bidder acknowledges further that, should their bid be accepted as the high bid, they are legally responsible to consummate the sale not later than 14 days following the auction sale.
NO FIREARMS WILL BE TRANSFERRED IMMEDIATLY. Firearm laws and regulations require certain background checks and waiting periods. Transfers will be in accordance with all federal and state laws. Winners are responsible for firearms shipment from ACGG's designated FFL to the winner's preferred FFL dealer.
ALL TANGIBLE ITEMS THAT ARE NOT PAID FOR UP WITHIN 30 DAYS OF AUCTION DATE WILL BE CONSIDERED ABANDONED AND WILL BECOME PROPERTY OF ACGG, UNLESS ALTERNATE ARRANGEMENTS HAVE BEEN MADE IN WRITING WITH THE AUCTION MANAGER.
PAYMENT/SHIPPING TERMS
All auction sales shall be considered consummated only by means of making payment in full. Bidder further acknowledges that all credit card purchases shall be in the amount of the high bid submitted plus a 4% bank administrative fee and that in the instance of the purchase of physical items, buyer shall be solely responsible for packaging, shipping, and insurance expenses and/or the expense of the transfer of firearms from a local, licensed FFL holder to a FFL holder of the buyers choice.
DISCLAIMER OF LIABILITY
Consummation of a purchase, as described above, is an acknowledgement that the ACGG or its Board of Directors affirm that they have not in any manner inspected goods/services in the live auction, silent auction, or drawings that have been obtained from third parties.
The high bidder or winning ticket holder acknowledges that the goods have not been inspected by ACGG, and is advised, in the case of firearms, knives, bullets, or other weapons to secure a competent inspection and test of the goods before use. GOODS AND SERVICES ARE SOLD OR RAFFLED “AS IS” WITH ALL FAULTS AND DEFECTS, AND WITHOUT ANY EXPRESS OR IMPLIED WARRANTY ON THE PART OF ACGG. ACGG MAKES NO WARRANTIES OF FITNESS OR MERCHANTABILITY, AND EXPRESSLY DISCLAIMS THE SAME. ACGG does not accept any responsibility or liability for any product, design or use. Any written warranties with respect to the goods delivered to the purchaser are those solely of the manufacturer or their agents, and shall be the sole liability and responsibility of the manufacturer. All firearms obtained for this event will be transferred in accordance with federal, state and local regulations.
No services in the live auctions, silent auctions and raffles are to be or will be performed by ACGG as an institution. ACGG shall bear no responsibilities for the delivery or quality of any of the services or for any loss or damages arising from or related to or connected with the performance or non-performance of such services. The high bidder or winning ticket holder further acknowledges that in the event services are purchased, ACGG cannot be responsible for or liable for any political unrest, epidemic, or instability that may occur inside or outside the confines of the United States, nor can ACGG be accountable for any injuries or damages that may arise therefrom. The high bidder or winning ticket holder further acknowledges that his/ her purchase is final and non-refundable under any and all circumstances, and that should legal action be required to collect for the services acquired by the high bidder at an auction, ACGG shall be entitled to all reasonable attorney’s fees, cost of court and interest as provided by law.
Neither ACGG nor specific hunt donors guarantee or warrant that trophy animals of any species, or that any animals of any quality, will be taken on any hunt/trip offered for sale by means of the ACGG auction.
CHARITABLE DEDUCTION QUALIFICATIONS
ACGG is a 501(c)(6) charitable organization under IRS regulations and as such, contributions to section 501(c)(6) organizations are NOT deductible as charitable contributions on the donor's federal income tax return.
