[SCI Gunnison Chapter]
AUCTION PROGRAM RULES & CONDITIONS OF SALE
[SCI Gunnison Chapter] (“Chapter”) is a nonprofit membership organization. These Auction Program Rules & Conditions of Sale (“Rules”) apply to all live, silent, and online auctions conducted by or for the benefit of the Chapter. By bidding on or purchasing an auction item, each bidder and purchaser agrees to be bound by these Rules and any applicable auction description, bid sheet, or Buyer’s Agreement. Exceptions must be approved by the Chapter’s Board of Directors.
1. BIDDING AND PURCHASE
For a live auction, a bidder or authorized representative must be registered and present (in person or via the Chapter’s online auction platform). A representative bidding for another person or group must have written authorization specifying the authorized items and bid limit for each item.
The auctioneer has final authority to resolve bidding disputes and determine the winner bidder. The Chapter is not responsible for missed or unexecuted bids.
At the conclusion of bidding, the winning bidder is obligated to purchase the item. A signed Buyer’s Agreement, Silent Auction Bid Sheet, Sealed Bid Form, or electronic acceptance constitutes a binding agreement to purchase and pay for the item.
2. PAYMENT; ALL SALES FINAL
Purchases must be paid in full using an approved payment method. Unpaid purchases are subject to all legal remedies and, for Chapter members, membership sanctions.
ALL SALES ARE FINAL. Purchases are nonrefundable and non-exchangeable unless otherwise agreed in writing by the Chapter. Purchasers are responsible for taking possession of items; property left at the auction location is at the purchaser’s risk.
3. AUCTION ITEMS SOLD “AS IS”; NO WARRANTIES
All items, goods, hunts, trips, and services are provided AS IS, without warranty by the Chapter. Descriptions, values, appraisals, photographs, are based on third-party information, which the Chapter does not independently verify. The Chapter disclaims all warranties, express or implied, including authenticity, condition, quality, value, merchantability, or fitness for a particular purpose. Acceptance of an item does not constitute an endorsement. Purchasers should obtain appropriate inspections before using firearms, knives, bows, ammunition, or hunting equipment
4. HUNTS, TRIPS, AND THIRD PARTY SERVICES
Hunts, trips, services, and other experiences offered at auction are provided by third parties. Purchasers are responsible for contacting the donor promptly to arrange scheduling, travel, licenses, permits, applications, and other required documentation, as well as paying any unlisted additional costs. The Chapter does not control donor performance, guarantee availability, ensure success, or promise satisfaction. Time-sensitive items must be used within one year of purchase unless otherwise stated. Failure to complete arrangements timely may result in forfeiture.
5. FIREARMS AND WEAPONS
Firearm transfers will comply with applicable federal, state, and local laws, including transfers through a federally licensed firearms dealer (“FFL”) where required. Out-of-state purchasers may require delivery through an FFL in their state of residence. The purchaser is responsible for all associated FFL fees background-check fees, permit requirements and waiting periods.
6. TAXES AND TAX TREATMENT
Purchasers are responsible for all applicable sales, use, VAT, GST, or governmental taxes, fees, and charges. Because the Chapter is exempt under Internal Revenue Code Section 501(c)(4), amounts paid for auction items generally are not deductible as charitable contributions. Purchasers should consult a tax adviser for tax guidance.
7. ASSUMPTION OF RISK; LIABILITY; INDEMNIFICATION
The purchaser assumes all risks associated with the possession or use of an auction item or participation in a purchased hunt, trip, service, or activity. To the fullest extent permitted by law, the purchaser releases and holds harmless the Chapter and its directors, officers, employees, agents, and representatives from any and all claims for injury, property damage, loss, or other direct, indirect, incidental, or consequential damages arising from or relating to an auction purchase or participation in a purchased activity.
The purchaser will indemnify, defend, and hold harmless the Chapter and its directors, officers, employees, agents, and representatives against any third-party claims, liabilities, judgments, costs, and reasonable attorneys’ fees arising from or relating to the purchaser’s possession or use of an auction item or participation in a purchased hunt, trip, service, or activity.
8. GOVERNING LAW AND VENUE
These Rules are governed by the laws of the State of Colorado__, without regard to conflict-of-laws principles and except as preempted by federal law. Any legal action arising out of or relating to these Rules, an auction, or an auction purchase must be brought in the state or federal courts located in Gunnison County, Colorado, and the purchaser consents to the jurisdiction and venue of those courts. Any claim must be filed within one (1) year after it accrues or it is barred. If any party brings a legal action arising out of or relating to these Rules or an auction purchase, the prevailing party in such action will be entitled to recover its reasonable attorneys’ fees and costs.
