The rear sight is a "u"-notch dovetailed to the rear of the slide. stock configuration & condition/ grip: the grips are two-piece julius posselt serrated synthetic panels. The grips show minor handling wear with a few light scuffs and handling marks. The serrations are well defined. There are no chips or cracks. Overall, the grips are in fine condition. type of finish: bluefinish originality: refinished. Numbered parts match. The unserrated slide-stop has been replaced, some other small parts may have been replaced. bore condition: the bore is light gray. The rifling is sharp. There is scattered light erosion and pitting in the bore. In this writer's opinion, the bore rates about 6/10. overall condition: the pistol retains about 97% of its current metal finish. The finish is generally strong throughout. There is faint handling wear in the grip strap. There are a few scattered minor marks. There are some nicks and spots of minor erosion under the finish. The action shows minor operational wear. The markings are generally clear, the acceptance mark on the right of the slide between the e/135 waffenamts is incomplete. The screwhead is lightly tool marked with a strong slot. Overall, the pistol is in very good-fine condition as refinished and not all-parts-original. mechanics: the action functions correctly. We have not fired this pistol. As with all used firearms, a thorough cleaning may be necessary to meet your maintenance requirements. box paperwork and accessories: the gun comes with a single 8-round magazine with e/135 waffenamt on the spine (mauser). our assessment: the parabellum pistole modell 1908 (the luger) was showing its age by the early 1930s and the german army began to seek out a new handgun. The design which most impressed the german army was the ap (armee pistole) designed by carl walther waffenfabrik, but the gun's concealed hammer design was considered inefficient and the gun was reworked to accommodate an external hammer. The resulting handgun was named the hp (heerespistole) and it featured an external hammer that allowed the gun to function as both a single or double-action. This improved design impressed the german army which opted to adopt the handgun as its new standard issue sidearm in 1938. There are only a few minor dimensional changes between the p. 38 and hp, they were done to facilitate mass production. Mauser had taken over the production of luger p. 08 semi-automatic handguns in the 1930s and produced the gun until mid-1941, the firm then took up production of the p. 38 with mass production of the more modern handgun beginning in 1942 and continuing until the end of wwii. The gun would remain the standard issue sidearm of the heer until its ultimate defeat at the end of wwii. The stalwart design remains in service with a number of military and police formations to this day. this particular specimen is a wwii-era p. 38 that was made by mauser in 1942. Mauser experienced significant troubles setting up manufacture, experiencing a rejection rate of up to 95 percent in december 1942, resulting in approximately 700 pistols actually being accepted by the army in 1942. There were a large number of 1942 production parts produced which were assembled into accepted pistols in early 1943, and it is essentially impossible to determined which byf42 pistols may have been accepted in each year, but they are scarce in any case. This specimen has been refinished and had at least one part replaced, the smooth slide stop, but retains serial matching parts and strong mechanics. This would be a neat piece for a mauser or german small arms collection. Please see our photos and good luck!

1.Acceptance of Terms: By participating in the auction, bidders agree to these Terms & Conditions, including any announcements or notices made during the auction.
2.Registration: Bidders must be at least 18 years old for long guns and 21 years old for handguns. A valid name, address, email and phone number is required.
3.Title Transfer: Ownership transfers to the highest bidder when the auctioneer closes the lot. Buyers assume all responsibility at that point.
4.Bidding: The auctioneer has the final say on bids and may reopen bidding in case of disputes. In-person bids take precedence over internet, absentee, and online bids. LSB is not responsible for technical issues or bid errors affecting bidding, and may remove disruptive attendees. In tie cases between internet bids, the auctioneer has the final decision. If utilities or internet services are interrupted, the auction will pause until restored.
Consignors are prohibited from bidding on their own items or using agents to do so. Any attempt to manipulate the auction may result in item withdrawal and further action.
Absentee Bidding: LSB accepts absentee bids via mail, phone, email, online, or in-person. Bids must be on the appropriate form with clear lot numbers and maximum bid amounts. In case of identical bids, the earliest received bid takes priority. Bids not in proper increments will be rounded down to the nearest increment.
Online Bidding: Online bidding is available through LSBauctions.com and third-party platforms. Additional platform fees may apply. Due to the fast pace, the auctioneer's call is final, even if an online bid is not processed in time. Accidental bids remain the bidder's responsibility.
Telephone Bidding: Phone bid requests are recommended be submitted at least three days before the auction. While LSB will attempt to accommodate requests, phone lines are not guaranteed. Contact LSB at (307) 527-8915 for arrangements.
5.Bid Results: Only buyers will be contacted. Invoices are sent within 72 hours, including applicable fees. Bid verification is available two business days after the auction. LSB does not share bidder information.
6.Reserve Prices: Some lots may have a confidential reserve price. The auctioneer may bid on behalf of the seller until the reserve is met and may indicate if bidding against the reserve.
7.Buyer's Premium and Taxes: A 16.5% discounted buyer's premium applies to phone, in-person, and direct Live.LSBauctions.com bids paid with cash, check or wire transfer. A 20.5% buyer's premium applies to phone, in-person, and Live.LSBauctions.com bids paid by card. Third-party bidding platforms may charge additional fees to be paid by buyer. Tax-exempt buyers must provide valid resale permits to LSB at least five days before the auction. Refunds for taxes are possible within four business days if proper documentation is provided.
8.Payment: Accepted payment methods include credit card, checks, wire transfers, money orders, and cash. Invoices must be paid within 14 days of their receipt. Late payments incur storage fees of $50 per item per month. After 90 days, unpaid items may be resold, with proceeds applied to outstanding balances. A 25% restocking fee applies if a transaction is canceled.
Credit Cards: Online payments are accepted only from the buyer named on the invoice. Chargebacks are not permitted. Credit card fraud will be reported to law enforcement.
Checks: Returned checks incur a $35 fee. First-time check payments may require a bank letter of credit.
Non-Payment: Failure to pay may result in legal action and a permanent ban from future auctions.
9.Shipping: Shipping costs are the buyer's responsibility and billed on the invoice. Modern firearms must be shipped to an ATF-licensed FFL dealer. C&R firearms may be shipped to the address on a C&R license if allowed by state law.
FFL Responsibility: Buyers must arrange transfers with their receiving FFL, who must submit a current FFL copy for each invoice to sales@LSBauctions.com.
International Shipping: LSB does not ship firearms outside the U.S. International buyers must arrange export and assume all risk and duties.
Shipping Damages: Report damages immediately with photos of the packaging before and after opening. Claims require evidence for processing.
Returns: Non-damage or non-misrepresentation returns are the buyer's responsibility. Approval is required for all returns and are only accepted within 30 days of the sale. See Warranties & Representations below for more information.
Address and Timing: Verify your shipping address on the invoice. Items generally ship within 1 to 14 business days after payment and FFL receipt.
Insurance and Oversize Fees: Insurance will be billed at 1.5% of the hammer price. Oversized items may incur additional fees.
Ammunition: Ammunition ships separately and may incur extra charges.
Delivery: All firearm shipments require an adult signature. Buyers are responsible for redelivery fees if needed.
10.Protected Species: LSB is not responsible for items containing protected species materials (e.g., ivory, tortoise shell, crocodile skin, coral). Buyers must comply with all applicable laws, including CITES, ESA, and MMPA.
Some states, including California, New York, and New Jersey, restrict the sale of such items. International buyers should check their country's import laws before bidding. Obtaining permits or licenses is solely the buyer's responsibility, and LSB cannot assist with this process. Delays or inability to obtain necessary permits will not justify canceling a purchase or delaying payment. Buyers agree to adhere to all restrictions as a condition of the sale.
11.Warranties & Representations: Bidders are responsible for requesting information and inspecting items before bidding. In-person bidders must note discrepancies before leaving. Online or absentee bidders should inspect items upon receipt and report major issues within 30 days of the auction. Late payments or actions that delay delivery void the guarantee. LSB guarantees for 30 days against errors in descriptive facts (e.g., manufacturer, model, caliber) and major condition discrepancies (+/- 20% finish or bore condition). This limited guarantee does not cover minor imperfections, natural wear, or operational issues. Items in this auction are sold "as-is" and have no guarantee. Our descriptions and photos are our best attempt to help you make an informed bidding decision.
Buyers may submit written refund requests within 30 days for valid discrepancies. Approved returns must be received within 7 days, and refunds cover only the purchase price. A restocking fee of up to 25% may be charged.
12.Firearms Transfer and Eligibility: All firearm transfers comply with applicable laws. Buyers must ensure they can legally own firearms before bidding. Ineligibility does not void the purchase, and a 25% restocking fee applies for failed transfers. Firearms transfer only to the registered buyer; no re-invoicing is allowed.
13.Denial of Transfer: If an FBI/NICS check results in a denial, buyers remain responsible for payment. The firearm will be resold at a future auction. Appeals are allowed with a 30-day grace period, after which storage fees apply. Only registered buyers can pick up firearms. Modern firearms require valid Wyoming paperwork. C&R firearms need a valid C&R license, and antiques require photo ID for those 18+.
NFA Transfers: NFA items require an FFL and SOT for processing. Payment is required even if ATF denies possession.
14.Liability: LSB is not responsible for errors in descriptions or any resulting losses. The auction may be canceled or postponed at LSB's discretion.
15.Safety: All firearms are sold as collectibles without safety guarantees. Buyers are solely responsible for firearm safety and should have all firearms inspected by a qualified gunsmith before use. LSB assumes no liability for damages, injury, or death resulting from misuse or defective merchandise.
16.Denial of Sale & Withdrawal: LSB reserves the right to deny sales or withdraw items without liability.
17.Governing Law: All claims related to LSB or its Terms & Conditions are governed by Wyoming law. Disputes must be resolved in Park County, Wyoming, and buyers waive objections to the jurisdiction. LSB's failure to enforce any rights does not constitute a waiver. Waivers must be in writing and signed. If any part of the Terms is deemed invalid, remaining provisions remain enforceable. These Terms benefit LSB and its affiliates, with no third-party beneficiaries.
