1. ABOUT MOOSE MAINE KIDS
Moose Maine Kids ("MMK," "we," "us," or "our") is an organization based in the State of Maine that conducts online auctions of guided hunting experiences and firearms to raise funds supporting youth outdoor education and conservation programs. MMK is committed to operating all auctions in full compliance with applicable federal, state, and provincial laws governing the sale of firearms and hunting activities.

2. ELIGIBILITY TO BID AND PURCHASE
2.1 General Requirements
To participate in any Moose Maine Kids auction, you must:
Be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater).
Be a legal resident of the United States or Canada.
Possess the legal capacity to enter into a binding contract.
Not be prohibited by any federal, state, provincial, or local law from purchasing, possessing, or transferring firearms or hunting licenses.
Provide accurate, complete, and current registration information.
2.2 Firearms Purchasers — Additional Requirements (USA)
Bidders purchasing firearms who reside in the United States must:
Be legally eligible to purchase and possess a firearm under the Gun Control Act of 1968 (18 U.S.C. § 922) and all applicable state laws.
Designate a licensed Federal Firearms Licensee (FFL) dealer in their state to receive the firearm transfer.
Successfully complete a NICS (National Instant Criminal Background Check System) background check through the receiving FFL dealer prior to taking possession of any firearm.
Comply with all applicable state waiting periods, registration, and permitting requirements.
2.3 Firearms Purchasers — Additional Requirements (Canada)
Bidders purchasing firearms who reside in Canada must:
Hold a valid Possession and Acquisition Licence (PAL) or Restricted PAL, as applicable to the firearm classification under the Firearms Act (Canada).
Arrange for all required import permits, transportation authorizations, and carrier compliance under the Export and Import Permits Act (Canada) and applicable Canada Border Services Agency (CBSA) regulations.
Understand and accept that MMK will coordinate transfer through a licensed Canadian firearms dealer or importer; all associated costs are the buyer's responsibility.
Comply with all applicable provincial and territorial firearms laws.
2.4 Hunt Purchasers
Bidders purchasing guided hunting experiences must:
Obtain all required hunting licenses, tags, permits, and stamps in the jurisdiction where the hunt will take place prior to the hunt date.
Comply with all applicable federal migratory bird, big game, and wildlife regulations.
Meet any outfitter- or guide-specific requirements communicated at or before booking.
Be in adequate physical condition to participate in the hunt as described.
3. AUCTION PROCESS
3.1 Lot Descriptions
MMK makes reasonable efforts to accurately describe all auction lots, including hunt packages and firearms. All descriptions are provided in good faith; however, MMK does not warrant that descriptions are error-free. Bidders are encouraged to contact MMK with questions before bidding.
3.2 Bidding
All bids are in U.S. Dollars (USD) unless expressly stated otherwise.
A bid constitutes a binding offer to purchase the lot at the stated price plus applicable fees, taxes, and shipping.
Bids may not be retracted once placed except in cases of manifest clerical error, at MMK's sole discretion.
MMK reserves the right to reject any bid for any reason, including but not limited to concerns about bidder eligibility.
The highest qualified bidder at the close of the auction is the winning bidder.
3.3 Reserve Prices & Buy-Now
Certain lots may carry a reserve price (minimum acceptable price) or a Buy-Now option. Reserve prices are not disclosed. If the reserve is not met, MMK is not obligated to sell. Buy-Now prices, when offered, close the auction immediately upon payment.
3.4 Auction Extensions
To prevent bid sniping, auction end times may be automatically extended if a bid is placed within the final minutes of the auction period. MMK reserves the right to extend, cancel, or restart any auction for operational reasons.
4. PAYMENT TERMS
4.1 Payment Deadline
Winning bidders must complete full payment within five (5) business days of receiving a winning notification. Failure to pay within this period may result in forfeiture of the auction, cancellation of bidding privileges, and potential legal action for damages.
4.2 Accepted Payment Methods
Major credit cards (Visa, MasterCard, American Express, Discover)
ACH/bank transfer (USA bidders)
Wire transfer (for lots exceeding $2,500 USD)
Certified check or money order (made payable to Moose Maine Kids)
MMK does not accept cryptocurrency, cash, personal checks, or payment applications (e.g., Venmo, Zelle) unless specifically authorized in writing.
4.3 Taxes and Fees
Buyers are responsible for all applicable sales tax, use tax, GST/HST/PST, customs duties, and import fees.
A buyer's premium may apply to certain lots and will be disclosed in the lot description.
Credit card payments may incur a processing surcharge as disclosed at checkout.
5. FIREARMS — SPECIAL TERMS AND CONDITIONS
5.1 Legal Compliance
ALL firearm sales are conditioned upon strict compliance with applicable law. MMK will NOT transfer any firearm to any person who is prohibited by law from owning, possessing, or receiving a firearm. The purchaser bears sole responsibility for determining the legality of the firearm in their jurisdiction prior to bidding.
5.2 FFL Transfer (USA)
The winning bidder must provide the name, address, and federal firearms license number of their chosen FFL dealer within five (5) business days of winning.
MMK will ship the firearm directly to the designated FFL dealer, freight prepaid (standard shipping; expedited shipping is at the buyer's expense).
The FFL dealer will conduct the required background check. MMK will not release firearms until the FFL dealer confirms readiness to receive.
All FFL transfer fees charged by the receiving dealer are the sole responsibility of the buyer.
If a background check is delayed or denied, the buyer remains responsible for the purchase price. MMK will work in good faith to accommodate a delayed transfer; a denied transfer will result in the firearm being returned to MMK, and no refund will be issued unless MMK, at its sole discretion, determines a refund is appropriate.
5.3 Canadian Import
MMK will cooperate with the buyer's designated Canadian licensed dealer/importer to facilitate export from the USA and import into Canada. All export permits, import permits, brokerage fees, duties, GST/HST, and transportation costs associated with Canadian importation are the buyer's sole responsibility. MMK makes no representations regarding the admissibility of any firearm under Canadian law and strongly encourages Canadian bidders to consult legal counsel prior to bidding on firearms.
5.4 Firearm Condition & Description
Firearm condition is described using the NRA grading system (New, Excellent, Very Good, Good, Fair) or as otherwise specified. Serial numbers are documented. Firearms are shipped unloaded and in compliance with applicable federal packaging and carrier requirements. MMK is not responsible for normal variations between a firearm's described and actual condition where such variations are within industry-standard tolerance.
5.5 Prohibited Jurisdictions
Certain firearms may be prohibited in specific states, provinces, or territories. It is the bidder's sole responsibility to determine whether a specific firearm is legal in their jurisdiction before bidding. MMK will not issue refunds due to local prohibition discovered after the auction closes.
6. GUIDED HUNTING EXPERIENCES — SPECIAL TERMS
6.1 Hunt Package Details
Each hunt lot description will specify, at a minimum: the species targeted, the general geographic location, the duration of the hunt, included accommodations and meals (if any), guide services, and any exclusions. Specific dates must be scheduled directly with the outfitter or guide service within the time period stated in the lot description.
6.2 Scheduling
Hunt packages must be scheduled within the booking window specified in the lot description (typically twelve (12) to twenty-four (24) months from auction close). Hunt dates are subject to availability and must be confirmed with the outfitter. MMK is not responsible for scheduling conflicts arising from the buyer's unavailability or failure to contact the outfitter in a timely manner.
6.3 Licenses and Permits
The buyer is solely responsible for obtaining all required hunting licenses, tags, draws, permits, and stamps. In many jurisdictions, tags are obtained by draw and are not guaranteed. MMK makes no representation that a tag or permit will be available for any given season. The failure to draw or obtain a required license does not entitle the buyer to a refund.
6.4 Non-Transferability
Hunt packages are non-transferable unless expressly stated otherwise in the lot description. The registered winning bidder must be the hunt participant. No substitutions of participants are permitted without the prior written consent of both MMK and the outfitter.
6.5 Physical Condition & Assumption of Risk
Hunting involves inherent risks, including but not limited to physical injury, exposure to wild animals, difficult terrain, and adverse weather. By purchasing a hunt package, the buyer acknowledges and assumes all such risks and agrees to hold MMK harmless from any injury, illness, death, or property damage arising from participation in the hunt.
6.6 Outfitter Cancellation
In the rare event that an outfitter cancels due to circumstances beyond MMK's control (e.g., natural disaster, regulatory closure, guide illness), MMK will use commercially reasonable efforts to arrange an alternative date or a comparable substitute hunt. If no suitable alternative can be arranged, MMK will issue a refund of the purchase price paid for the hunt package. This constitutes the buyer's sole remedy in such circumstances.
7. SHIPPING AND DELIVERY
7.1 Firearms
Firearms are shipped via federally licensed common carrier (e.g., FedEx, UPS) to the buyer's designated FFL dealer only. Shipping costs are included in the purchase price for standard ground shipping within the contiguous 48 states. Alaska, Hawaii, and Canadian shipments may incur additional freight charges disclosed at checkout. Risk of loss transfers to the buyer upon delivery to the FFL dealer.
7.2 Hunt-Related Items
Physical items associated with hunt packages (e.g., apparel, gear, certificates) are shipped via standard carrier. Buyer provides a valid shipping address at checkout. MMK is not responsible for carrier delays. International shipments to Canada are subject to applicable customs and duty charges payable by the buyer.
7.3 Title and Risk of Loss
Title and risk of loss pass to the buyer upon shipment (for items shipped directly) or upon delivery to the FFL dealer (for firearms). MMK strongly encourages buyers to arrange appropriate insurance for high-value shipments.
8. RETURNS, REFUNDS, AND CANCELLATIONS
8.1 All Sales Final
ALL AUCTION SALES ARE FINAL. MMK does not accept returns or offer refunds except in the following limited circumstances:
A firearm is materially misdescribed (e.g., wrong model or caliber delivered) and the item was described inaccurately in the lot listing.
A firearm transfer is permanently denied by NICS and no alternative transfer can be arranged within 90 days.
An outfitter permanently cancels a hunt and no suitable alternative is available, as described in Section 6.6.
MMK, in its sole discretion, determines a refund is warranted due to MMK error.
8.2 No Buyer's Remorse Refunds
Refunds will not be issued for: change of mind, failure to obtain required licenses or permits, bidder ineligibility discovered after auction close, local prohibition of a firearm, scheduling conflicts, or physical inability to participate in a hunt.
8.3 Dispute Process
Refund requests must be submitted in writing to auctions@moosemainekids.org within ten (10) days of the event giving rise to the claim. MMK will review and respond within fifteen (15) business days.
9. BIDDER CONDUCT AND PROHIBITED ACTIVITIES
Bidders are prohibited from:
Submitting false or misleading registration information.
Bidding on items they are legally prohibited from purchasing.
Shill bidding, bid manipulation, or any form of auction fraud.
Interfering with the auction platform, other bidders, or MMK's operations.
Purchasing on behalf of a prohibited person or as a straw purchaser for a firearm.
Reselling firearms without compliance with all applicable transfer laws.
Violation of these prohibitions may result in immediate disqualification, forfeiture of any amounts paid, permanent ban from future auctions, and referral to appropriate law enforcement authorities.
10. PRIVACY AND DATA USE
MMK collects personal information (including name, address, date of birth, and payment information) as necessary to administer auctions, comply with legal obligations (including federal firearms recordkeeping under 27 C.F.R. Part 478), and process payments. MMK does not sell personal information to third parties. Information may be shared with FFL dealers, outfitters, payment processors, and law enforcement as required by law or to complete the transaction. 11. DISCLAIMERS AND LIMITATIONS OF LIABILITY
11.1 As-Is
ALL ITEMS ARE SOLD "AS IS, WHERE IS" UNLESS EXPRESSLY WARRANTED IN THE LOT DESCRIPTION. MMK MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MMK'S TOTAL LIABILITY TO ANY BIDDER OR BUYER SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE SPECIFIC LOT GIVING RISE TO THE CLAIM. MMK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND.
11.3 Platform Availability
MMK does not guarantee continuous, uninterrupted access to its auction platform. MMK is not liable for technical failures, internet outages, or platform errors that prevent bidding or cause a lost bid opportunity.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Moose Maine Kids, its officers, directors, volunteers, employees, agents, outfitters, and partner organizations from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law; (c) your participation in a hunt; (d) any misrepresentation made by you in connection with an auction; or (e) your receipt, possession, or use of any firearm purchased through MMK.
13. GOVERNING LAW AND DISPUTE RESOLUTION
13.1 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Maine, without regard to its conflict-of-laws principles, and applicable federal laws of the United States.
13.2 Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or any auction transaction, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall be conducted in Cumberland County, Maine. The arbitrator's decision shall be final and binding. Notwithstanding the foregoing, MMK reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-WIDE PROCEEDING.
13.4 Canadian Bidders
Canadian bidders acknowledge that these Terms are governed by Maine law, that they are responsible for complying with all applicable Canadian federal and provincial laws, and that they waive any right to bring claims in Canadian courts or under Canadian consumer protection statutes to the extent permitted by applicable law.
14. MODIFICATIONS TO TERMS
MMK reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on the MMK website with a revised effective date. Continued participation in auctions following such modification constitutes acceptance of the revised Terms. Material changes will be communicated via email to registered bidders.
15. MISCELLANEOUS
15.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of these Terms shall remain in full force and effect.
15.2 Entire Agreement
These Terms and Conditions, together with any lot-specific terms, constitute the entire agreement between MMK and the bidder/buyer with respect to online auctions and supersede all prior agreements and understandings, whether written or oral.
15.3 No Waiver
MMK's failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.
